Ocean Money EU EOOD ("OceanX," "we," "us," or "our"), provides services via https://oceanx.trade (the "Platform") and related software, APIs, smart contracts, documents, and infrastructure (collectively, the "Services").
These Terms of Use ("Terms") govern your access to and interaction with the Platform and Services. By accessing or using them, you acknowledge that you are at least 18 years old, legally capable of forming binding contracts, and accept all the terms below.
1. Acceptance & Applicability
- Your use of OceanX is conditional on your acceptance of these Terms, including our Privacy Policy, which is incorporated herein by reference.
- If you do not agree to these Terms, please refrain from using the Platform or Services.
2. Eligibility & Restricted Jurisdictions
- You must be of legal age and not subject to sanctions or prohibited by applicable law or regulation.
- We reserve the right to restrict or terminate access from individuals in jurisdictions where our Services are unlawful or prohibited, including but not limited to certain high-risk or sanctioned regions. Attempts to circumvent these restrictions (e.g., via VPNs) are prohibited.
3. Account Registration & Responsibilities
- You may need to create an account ("Account") to access certain features. You must provide accurate and up-to-date information.
- Maintain the confidentiality of your credentials and notify us immediately of any unauthorized access.
- You are accountable for all activity conducted under your Account. We may suspend or terminate your Account for breach of these Terms or suspicious activity.
4. Digital Assets & Private Keys
- OceanX operates on a non-custodial basis. Your private keys are stored solely in your browser's local encrypted storage ("Device Storage").
- You are fully responsible for securely storing your keys. We do not retain any copies and cannot assist in recovery if lost.
- Anyone with access to your keys can access your assets. OceanX disclaims all liability for any loss arising from key mismanagement.
5. Feedback & Content
- All feedback you provide grants us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, adapt, and commercialize it.
- "User Content" (e.g., posts or uploads) remains yours, but OceanX may use and display it under a similar license unless otherwise agreed. Removal requests may not fully delete copies stored by third parties.
6. Compliance & Legal Obligations
- We hold the right to conduct Know Your Customer (KYC) and Anti-Money Laundering (AML) checks when mandated by law or at our discretion.
- Non-compliance may lead to denial of access or sharing of information with legal authorities.
7. Arbitration & Dispute Resolution
- To the maximum extent allowed by applicable law, disputes will be resolved through individual arbitration, not class actions or jury trials.
- This arbitration requirement aims for efficient, impartial resolution of disputes.
8. Modifications to Terms & Services
- OceanX may change these Terms or discontinue features at any time. Material changes will be posted on the Platform, and we may notify you via email or in-app alerts.
- Continued use after updates constitutes acceptance. If you disagree with changes, please stop using the Platform.
9. Third-Party Services
- OceanX may integrate third-party tools or services (e.g., analytics, providers). Their use is governed by those parties' terms and policies.
- In case of conflict between this document and third-party terms, these Terms take precedence where legally permissible.
10. Limitation of Liability
- Use the Platform at your own risk. OceanX (and its affiliates) are not liable for direct or indirect losses resulting from access issues, bugs, downtime, market volatility, technical failures, user errors, or third-party actions.
